Terms of Service
[COMPANY LEGAL NAME] (“we,” “us”) ·
Effective [DATE]
These Terms cover your use of the WDI inspection app at
https://wdi-diagram.pages.dev (the “Service”). “You” means the pest
control business that signs up (the “Company”) and everyone it adds to
its account. By creating an account or using the Service, you agree to
these Terms.
1. What the Service does
The Service helps licensed inspectors prepare Texas Department of
Agriculture (TDA) SPCS/T-5 Wood Destroying Insect Inspection Reports. It
lets you fill in the report, draw a diagram, attach photos, issue a PDF,
keep your records, and optionally pull jobs from scheduling software you
connect.
2. Accounts and your team
- The person who creates the Company account is its owner. The owner
and admins control who has access and what they can see.
- You’re responsible for everything done under your account, for
keeping passwords private, and for removing access when someone
leaves.
- Tell us right away at [SUPPORT EMAIL] if you think your
account has been misused.
3. You make every call on the
report
- The Service is a tool. The licensed inspector and the
Company are solely responsible for the inspection, the findings, and
everything in every report, including whether it’s complete,
accurate, and meets TDA rules, the Texas Structural Pest Control Act,
and any other law.
- Photo “Identify” is a suggestion only. It uses
artificial intelligence and can be wrong. It never decides what goes on
a report. Don’t rely on it in place of your own inspection and
judgment.
- Automatic features like default answers, standard comments,
automatic Section 12 checks, auto-drawn diagrams, and dates are
conveniences. Check them on every report.
- You’re responsible for keeping your records as long as the law
requires (TDA currently requires at least 2 years). You can download all
your data at any time (section 6).
4. Free trial, plans, and
payment
- New Companies get a free trial of 14 days. After the trial,
continued use requires a paid plan.
- Prices are shown at checkout. They’re billed monthly in advance
through our payment processor (Stripe), [per Company / per active
team member].
- You can cancel anytime in the app. Cancellation takes effect at the
end of the paid period. We don’t give refunds for partial periods unless
the law requires it.
- We may change prices with at least 30 days’ notice. The change
applies at your next renewal.
- If a payment fails, we may limit issuing new reports until it’s
fixed. Your existing reports and data stay available to download.
5. Your data belongs to you
- You own the information you put into the Service (“Your Data”):
inspection answers, diagrams, photos, signatures, issued reports, and
your clients’ and agents’ contact details.
- You give us permission to host, store, copy, process, and send Your
Data only as needed to run the Service for you. That
includes syncing it between your devices, emailing reports when you tell
the app to, and sending photos to our AI providers when you tap
Identify.
- You confirm you have the right to put Your Data into the Service,
including any personal information about your clients.
6. Download and deletion
- An owner or admin can download everything (every inspection, issued
PDF, and photo) at any time from Setup → Your data.
- If your account ends, you’ll have 30 days to download your data.
After that we may permanently delete it. We aren’t responsible for
keeping your records after that point.
7. Using photos to
improve the identifier
- To make Identify more accurate, we may use photos from the Service
with personal information removed. That means no addresses, names,
faces, license plates, report numbers, or anything else that ties a
photo to a property or person. We use them only to train and test our
wood destroying insect identification. We never sell them and never
publish them in a way that identifies you or your clients.
- You can opt out at any time by emailing [SUPPORT
EMAIL]. Opting out doesn’t affect the rest of the Service.
8. Other services you connect
If you connect other services, such as ISN, Spectora, GoHighLevel, or
email, your use of them is covered by their own terms. We aren’t
responsible for how they work or for changes they make. We store your
credentials for them encrypted and use them only to do what you set
up.
9. Acceptable use
Don’t misuse the Service. That means: - no breaking or probing its
security - no reselling it without our written permission - no false or
misleading reports - no uploading anything illegal - no using it to
violate anyone’s privacy
We may suspend accounts that do.
10. Availability
The app is built to work without a signal and sync later, but we
can’t promise the Service will always be available, error-free, or never
lose data. Keep your own copies of issued reports; the download in
section 6 makes that easy.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST
EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, INCLUDING
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND
NON-INFRINGEMENT. WE DON’T WARRANT THAT ANY REPORT PREPARED WITH THE
SERVICE, OR ANY IDENTIFY SUGGESTION, IS CORRECT OR COMPLIANT.
12. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE AREN’T LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR
FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM THE SERVICE
OR ANY REPORT. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO WHAT YOU
PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
13. Your responsibility to us
You’ll defend and cover us against claims, fines, and costs
(including reasonable attorney’s fees) arising from: - your inspections
and reports - your use of the Service - Your Data - your breaking these
Terms or the law
14. Ending the agreement
You can stop using the Service and cancel anytime. We can suspend or
end your access if you break these Terms or don’t pay, and we’ll give
notice when we reasonably can. Sections 3, 5 through 7, and 11 through
15 continue after the agreement ends.
15. General
- Texas law governs these Terms. Any dispute goes to the state or
federal courts in [COUNTY] County, Texas.
- We may update these Terms. We’ll notify you in the app or by email
at least 30 days before a material change takes effect. Continuing to
use the Service after that means you accept the change.
- If any part of these Terms is unenforceable, the rest still applies.
These Terms are the whole agreement between us about the Service.
